LIABILITY WAIVER & ASSUMPTION OF RISK(Required)

I have read, understand, and agree to the Membership Agreement

I agree to a minimum of a 3-month membership at the Vail Racquet Club. This membership is not 3-months only, it is a minimum of 3-months. Memberships will continue after the 3 -month period until they are canceled by the member. Memberships are payable monthly via credit card or EFT from a checking account. Monthly dues will be billed on the 1st of each month and drawn from accounts on the following day. I agree to follow the Membership Pledge upon sign up. Furthermore, the Vail Racquet Club reserves the right to terminate this membership on any of the following grounds, nonpayment of dues, violation of club rules or code of conduct, abusive or threatening behavior, misuse of equipment or facilities, providing false information on the membership application or letting non-members use the membership illegally (i.e., sharing id cards). No children under the age of 14 will be permitted in the Vail Racquet Club without adult supervision.

No cancellation fees apply after the initial 3-month agreement. If I cancel within the 3-month agreement I will be responsible and charged for the full 3 months. I understand should I decide to cancel after the initial 3 months but within a monthly membership term I will not receive a refund of dues for the current month. Memberships are renewed automatically on the 1st of each month and charged to the credit card on file. To cancel my membership after the 3-month agreement, I must complete a Cancellation Form 7 days in advance. All outstanding dues must be paid in full before the membership can be terminated. Any unpaid dues will be sent to collections after 60 days.

I understand that engaging in exercise and fitness participation is potentially hazardous and could result in bodily injury and is done at the risk of the member and his/her family. I acknowledge further and agree that the Vail Racquet Club, its officers, agents, and employees do not undertake any responsibility for injuries sustained during exercise or fitness participation at the Vail Racquet Club. The Vail Racquet Club is not liable for personal injury, theft, or loss of personal property. By signing this agreement, I agree to indemnify, defend, and hold the Vail Racquet Club, its officers, agents, and employees harmless against any and all expenses, costs, charges, bills, claims, damages, lawsuits, and liability for bodily harm or injury during the course of any activity or as a result of the activity at the Vail Racquet Club.

I accept all risks and agree to release the Vail Racquet Club and its agents from all liability during the use of the facility, or while participating in any Vail Racquet Club programs which may cause personal injury or illness to me or any individuals in my group. I further agree to indemnify and hold harmless the Vail Racquet Club, the RCOA, its Board of Directors, homeowners, members, agents, employees, vendors, assigns, and affiliated persons or representatives.

The Vail Racquet Club is not responsible for any lost or stolen items while on the premises.
